1. KinkWeb's Position

KinkWeb is a transmission, display, and hosting service operated by QLynx Technologies. KinkWeb is not a producer of the visual depictions uploaded by its users. KinkWeb does not create, commission, direct, manage, or meaningfully intervene in the creation of any visual depiction uploaded to the Service. KinkWeb's role is limited to providing technical infrastructure that allows users to share content they themselves produced or that they are authorized to share.

Under 28 C.F.R. §75.1(c)(4), a "digitized or computer-manipulated image" is not itself primary-producer activity when the hosting service "merely transmits or hosts the content" on behalf of the uploading user. Consistent with that distinction, and with the position taken by similar user-generated-content platforms, KinkWeb does not assume primary-producer status or primary-producer record-keeping obligations for user-uploaded content.

This Statement identifies the uploading user as the primary producer and directs all §2257 inquiries regarding the content of a specific upload to that user through the channels described in Section 4.

2. Age Verification of Account Holders

Every KinkWeb account holder must attest at registration that they are at least 18 years of age. KinkWeb records the date of birth supplied at registration together with the timestamp at which the user affirmed they are of legal age (the age_verified_at attribute on each user record). No account is granted access to post or view sexually explicit user content until this verification is recorded.

Accounts discovered to belong to anyone under 18 are terminated immediately and all content associated with the account is removed. KinkWeb cooperates fully with any lawful investigation relating to suspected depiction of minors.

3. Uploaders Are the Primary Producers

By uploading any visual depiction to KinkWeb, the uploading user is designated the primary producer of that depiction under 18 U.S.C. §2257 and 28 C.F.R. §75.1(c). The uploader accepts all corresponding record-keeping, labeling, and statement-posting obligations. Section 4.4 of the Terms of Service sets out those obligations in full and requires the uploader to affirm, at the time of every upload, that:

  • Every person depicted was at least 18 years of age at the time the depiction was created;
  • Every person depicted has consented to the upload and distribution of the depiction on KinkWeb;
  • The uploader holds and will produce on request a government-issued photo identification for every person depicted together with all §2257 records required by 28 C.F.R. §75.2;
  • The uploader is the primary producer and retains all §2257 obligations that attach to that status.

At the moment of upload, KinkWeb presents a mandatory certification checkbox displaying the full affirmation text above. The user's confirmation — together with user ID, timestamp, IP address, and the exact text of the attestation version accepted — is written to an append-only audit log (the content_attestations table). Each audit row is retained for the statutory retention period required by 28 C.F.R. §75.4 and is produced on lawful request. No upload is permitted without this confirmation.

A user who uploads any visual depiction without being in compliance with the obligations set out above is in violation of these Terms and of U.S. federal law. KinkWeb will suspend and terminate the accounts of users who violate these obligations, remove the content, preserve associated logs for law-enforcement use, and cooperate fully with 18 U.S.C. §2258A reporting as applicable.

4. Referring §2257 Inquiries to the Uploader

Any §2257 inspection request, records request, subpoena, or other inquiry concerning a specific visual depiction hosted on KinkWeb should be directed in the first instance to the uploading user of that depiction. KinkWeb does not hold the uploader's primary-producer records and cannot produce those records on the uploader's behalf.

Requests for assistance identifying the uploader of a specific depiction may be submitted to the contact address in Section 5 together with the direct URL of the depiction, a description of the statutory authority under which the inquiry is made, and the name and contact information of the requestor. KinkWeb will respond to facially valid requests in accordance with applicable law and within the timelines required by the requesting authority.

5. Hosting Records Maintained by KinkWeb

Although KinkWeb is not a primary producer of user-uploaded content, it does maintain operational logs that can assist law-enforcement and §2257-inspection activity. Those logs consist of:

  • The uploading user's account record (pseudonymous user ID, encrypted email, account creation timestamp, age-verification timestamp);
  • For every upload, the content_attestations audit row described in Section 3, including the IP address used at upload and the exact attestation text confirmed;
  • Upload and access logs associated with each uploaded depiction.

These hosting records are retained at KinkWeb's server location and are made available on a facially valid request in accordance with applicable law. They are not primary-producer records and do not displace the uploader's own §2257 record-keeping obligations.

5. Content Not Subject to 2257

Content that does not depict actual sexually explicit conduct — including profile photos, text posts, artistic nudity, simulated conduct, and depictions that do not satisfy the statutory definition at 18 U.S.C. §2256(2)(A)(i)–(v) or §2256(2)(A)(vi) — is not subject to the record-keeping obligations of 18 U.S.C. §2257. Such content remains subject to KinkWeb's Community Guidelines and Terms of Service.

6. Reporting and Removal

If you believe content on KinkWeb depicts a person under 18, or was uploaded without the consent of a person depicted, report it immediately:

  • Email: legal@kinkweb.social
  • In-app: open the content, tap the flag icon, choose Underage or Non-consensual
  • If the content depicts a minor, also report to the National Center for Missing & Exploited Children at report.cybertip.org (US) or to your local law-enforcement authority.

We review all such reports within 24 hours (24/7 including holidays) and remove content at the first indication of a reasonable belief that a minor is depicted. Accounts associated with such content are immediately suspended pending investigation. KinkWeb reports to CyberTipline and cooperates with law-enforcement investigations as required by 18 U.S.C. §2258A.

7. Prohibition on Child Sexual Abuse Material

KinkWeb has zero tolerance for the depiction of any person under 18 in any context that sexualizes or exposes the minor to sexualized attention. This prohibition is absolute, extends to drawings, renderings, and AI-generated depictions, and is enforced without regard to the user's claimed consent or interpretation. Any account found to have uploaded, shared, or solicited such material will be terminated, all account data will be preserved for law enforcement, and the matter will be reported to the appropriate authorities.
